A special meeting of the Board of Trustees was held on Saturday, February 26, 2005, in the Village Hall. Mayor Maedl opened the meeting at 9:00 a.m. Also present were: Deputy Mayor Conley, Trustee Bateman, Trustee Herriven, Trustee Shuttleworth, Clerk-Treasurer Schweigert, DPW Superintendent Mahar, and Police Chief Swick. Correspondence was addressed first: X A letter was received from attorney Daniel E. Seaman indicating his hourly rate is now $148. X A letter was received from attorney Seaman recommending that attorney Paul Sikora be hired for union contract negotiations, given that he’s done the last two. A motion was made by Trustee Bateman, and seconded by Trustee Shuttleworth, authorizing the hiring of attorney Paul Sikora for the current union contract negotiations. Carried. X A contract was received from New York State DEC for the $20,000 Senator Maziarz procured for hiring a technical advisor. As Attorney Seaman recommended that a Trustee review this contract and work closely with the Clerk to carry it out, discussion ensued regarding who would be willing to do this. Trustee Shuttleworth recused himself as he works for FMC. Deputy Mayor Conley volunteered to review the contract. The following resolution was offered by Trustee Herriven, who moved its adoption, and was seconded by Deputy Mayor Conley, WHEREAS, the Village of Middleport, herein called the “Municipality,” after thorough consideration of the various aspects of the problem and study of available data, has hereby determined that certain work, as described in the State Contract, herein called the “Project” is desirable, in the public interest, and is required in order to study and/or implement the local project or program; and WHEREAS, under Chapter 53, Section 1, of the Laws of 2002 relating to the Local Assistance Budget, the Legislature has authorized financial assistance to localities for services and expenses related to local projects, programs, and studies by means of a written agreement; and WHEREAS, the Municipality has examined and duly considered Chapter 55, Section 1, of the Laws of 2002 relating to the Local Assistance Budget and deems it to be in the public interest and benefit under this law to enter into a contract therewith: NOW, THEREFORE, BE IT RESOLVED BY the Board of Trustees of the Village of Middleport: That the Mayor is directed and authorized as the official representative to act in connection with any contracts between the Municipality and the State and to provide such additional information as may be required; and That one (1) certified copy of this resolution be prepared and sent to the New York State Department of Environmental Conservation, Albany, New York, together with the State Contract; and That this resolution take effect immediately. The vote on the above resolution was as follows: Ayes: Mayor Maedl, Deputy Mayor Conley, Trustee Bateman, Trustee Herriven, and Trustee Shuttleworth. Nays: None. Abstentions: None. The resolution was duly passed. A motion was made by Trustee Herriven, and seconded by Deputy Mayor Conley, to authorize Mayor Maedl to execute the contract with the NYSDEC, based on Deputy Mayor Conley’s recommendation. Carried. X Attorney Seaman reviewed the draft shared services contract the County has proposed and advises against signing it. Following correspondence, the Board continued to review the budget. Discussions ensued regarding the following as each line item was reviewed for cuts or increases: X Letter to be sent to Janelle Salen asking for a final report for the rec. program. As Janelle is working full-time, the position of director will be offered to Grace Swick. The Honor Society will be contacted to see if this is a program that students can earn community service credit for by volunteering to help. X Discussed inviting the Fire Chief to the April Board meeting. X Set another meeting for budget review for March 9, 2005, at 1 p.m. Newspaper will be notified. X Ron Riley is returning to work from medical leave since September 2004. X The revenues and wages for the upcoming budget year will be discussed at the March 9, 2005, meeting. There being no further business, a motion was made by Deputy Mayor Conley, and seconded by Trustee Bateman, to adjourn. Carried. Meeting adjourned at 11:25 p.m. Respectfully submitted, Rebecca A.
